Dear Bruce and Lisa. You owe me a balance and I will collect. I asked you to have the dining set ready for pick up. You have held the goods, and avoided the return by some ” rule” or insinuation of one, when this is simply conversion. I will file in small claims for my furniture and the cost of use. You have not tried to resolved this situation you are as guilty and as irresponsible as your wife. I made a mistake on the height of the table and offered several solutions within 24 hours days including leaving you a working table, removal and replacement of the base. Your wife did not like the quality of the chairs that you ordered, Bruce you were given the choice and chose the cheaper kind of chairs and in front of my son and your wife you even tried to cheasel down the price. You received  the 1st set of chairs in the better quality only because I could not meet your deadline, that was my desition and I delivered on time. although it was my loss.  I offered to take the cheaper chairs to an artist to have them repainted at my expense she refused. I offred that to try to please you as customers and just to be able to collect my balance. You referred me to your secretary, in turn your wife the woman on the picture, asked me to avoid contacting you using a legal Firm’s email account, and impersonation someone else. This is the Modus Operand-um you two exercised on me, you used your law firm’s for intimidation purposes and scare me from obtaining my 50% balance or furniture. I will file a complaint to the California State Bar and that complaint remain be on file. Your wife after a series of ungracious turn downs, decides not to reply. I asked twice specifically “not to touch the furniture” and that I would pick up and refund the 50% deposit. So far with your invisible law, you held the furniture and have not paid nor returned the goods. I will post all emails in chronological order, it will take time but you can read each update when you get a reminder of the of this published page until we meet in court asshole.

Hi Bruce, OK we found the right iron person that will re do the base cutting all piece and re-bending them to scale.  Also found a Lady artist that has her own gallery and she will repaint all chairs, I can present them to you and Lisa, if you like them you can buy them, there is no obligation. This alternative will take 1 week from the day I deliver to them, most likely all ready in your home by next Sunday  p.m.   Another option for the chairs, If you can wait 3-4 months I can order the chairs from Artemio but the backs will be made in MDF.  No deposit required. Chairs can be ready by Easter.   Please consult with Lisa and let me know ASAP so I will know what to do.

Dear Oscar,   Please do not communicate with Bruce again with reference to the table and chairs.  You have caused my husband a great deal of anxiety (days of waiting for your promised appearance, lack of communication). He has had heart attacks in his history, and I am very protective of him.  All communication regarding this issue is to go through me.   Let me make it clear, woodworkingquality and style of the chairs is of poor quality, not just the painting.  The chairs are not of the same quality of workmanship as the first order and I will provide pictures if needed.   I will be communicating directly with an iron person to re-do the table height to match that of the height of the first table I ordered.  I have lost my trust with you on a number of levels.  If you want to pick up the table and chairs we can make these arrangements, however I will need a full refund of the order in advance.   I will not chase you in Mexico, having only your son’s telephone number (which he does not answer), communicating via email and not having a U.S. business gives me no assurance that I may recover from you.  I will not be left holding the bag. We have paid you in good faith substantial sums of money.   I intend to resolve this matter amicably, however the switching of the table base and taking back the chairs is not what we discussed.   I look forward to hearing from you.  Again, no communication is needed on part of my husband Bruce, all future communication will be with me through my executive assistant Martha Martinez. I have plenty of  respect for your husband and your son, I have not tried to communicate with him since he wrote to me saying his assistant would take care of this situation.   I propose, I take 2 metal heavy duty horse tables, place the door table with glass on them, then take only the iron base to be re-made in scale just as it was supposed be done in the right height.   I leave the chairs and table top w/glass in your possession.   1 week later when I return I will take the chairs you do not need to pay the 50% I will pay you a small $300+-  difference that is in your favor.

Dear Bruce, I do not wish to communicate through your agent. My requests for communication to resolve this matter has been with non-responsiveness and now you are transferring accountability to now another person—your proxy Martha Martinez.  Conforming merchandise was tendered upon delivery and you accepted delivery.  Now Lisa has created subjective and continuing demands.  Regarding the height of the table, I have offered to go to the site to alter the height of the table, but you have not responded to my repeated requests to arrange a mutually agreeable time and date. I can only interpret your refusal to communicate as bad faith conduct by Lisa and you. Bruce, I know you only want to appease Lisa, it is understandable. But Lisa’s arbitrary demands are increasingly unreasonable. Your refusal to allow me to change the height of the table has been unreasonable  Your refusal to pay the balance while keeping the merchandise is tantamount to conversion.  This is an invitation to “meet and confer.”

Bruce I spoke to lisa, and learned she is upset with the painting on the chairs, also I hadn’t realised We held You up from your activities. I am very sorry for that.   The chairs We delivered on Wednesday were not made by Artemio as were the 1 st set of chairs. and the quality is different, what I made is real wood, Artemio uses fiber-board (mdf) on the backs because the carving and painting is very easy.  Artemio is so busy he want 3-4 months lead time for any order.   I tried to make the chairs in better quality and I did I will attach pictures. The painting is not of the same quality in fine detail and when I 1st saw them I had your same impression, I liked them, faces look different and it was happy colorful.   I will take the chairs back, I will take them to a local artist and have them painted as they should if by then Lisa still would like to keep them it will be great, and if not it is OK. I can only apologise for the inconvenience.   On the table I called yesterday the Wrought Iron man who made it and asked for a new piece in the right height, my son and I will just exchange bases. Hello Bruce, I am sorry you have to be in this deal, You are the buyer.   I will pick up the chairs and exchange the table base this coming weekend, It is cheaper to pick up and fix and return but instead to make it easier for you I ordered a new piece for exchange.   I will still give you a 3/8″ thick x 3″ wide and not 1/4″ thick as your original piece, I am sure it was unnoticed as I did not mentioned that to or or Lisa. I am a one man small company I hope you understand. If Lisa wants to donate the chairs You will have to pay for them.   I focused on delivering good quality chairs and in the time that you needed them, before Thanksgiving and I did, the chairs I delivered are heavy hardwood fronts and base I did that on my dime because l meant to deliver good quality products.   Seats are also removable for easy repair on chairs or replacement of seat, also the 3/4″ solid wood under the weaving adds strength the the frame of the chairs as they are nailed to the frame.   I lost time in detouring to Los Angeles to take the glass to You, traffic and an accident but I made it on time. ( see pictures on your page)   I failed on the quality of the painting which is terrible for an artist as Lisa and for that I apologise.   Please respond to this email as as you can.   Thank you Oscar Almaguer

There is one person in Indio, Ca. that can fix the base, he needs to see it and says it will take 2 days. Bruce, I had requested not to touch the table to your wife via proxy sender. I said I had a customer that would the buy Dining Set and I asked your wife specifically not to touch the table, also asked her not call my son.  I did not want my son to ever speak to your wife after how she talked to me, she was beyond rude, she yelled she did not want to hear the history of Mexicans,  when I was only trying to explain what she got the on the 1st order of chairs and where those chairs were made at.   You should have told her what You ordered and what you paid for, its all in the emails, I would be happy to post all emails and pictures in a chronological order in a custom web page like yours so that yourself and others can read.   I went way out of my way to satisfy your order deadlines ThanksGiving Dinner and Xmas Dinner. You did not pay the balance its been 4 months. I must say, my wife and 2 kids had no great Xmas in fact I had a bad January because I chose to not take new orders to meet your deadlines and I agreed. But I also met those deadlines and did not got paid for my balance while all the furniture is in your possession have you ever sent me the address or your wife?   I can not comprehend why You stayed quiet for 4 months.   I personally don’t want you to have any of my furniture. But You altered the original table when I specifically told your wife not to touch the table.I will ad those emails in the web page as well.   I will need to have the table repair to be brought to its original shape and size at your expense and that would be more expenses, time delays, transportation, conversion etc  so Bruce because You and your son were kind enough to help me and my son getting jumper cables on that interior delivery-set up evening, so that we could go with barely with enough gas to make it home for Xmas. Oscar your history is not what I recall.  You specifically told me that you were going to pay to have the table repaired as it was defective due to your errors in both the thickness in the iron and the height of the table.  We were trying to see how to accommodate your request to repair it at your cost but you cancelled. As far as my wife complaining, yes, we ordered chairs from you once before.  They were all great.  We ordered the same chairs and the table.   You changed the manufacturer of the chairs and they are not the same chair.  We told you that when you delivered them.  They looked awful next to the first group.  You never told us you were not delivering the same chair, which is precisely what we ordered from you. I have all the emails as well Oscar.  Including the ones where I asked you for photographs for the chairs before you delivered them.  You told me that you would send the photo.  You never did.  Of course we now know that was because you were well aware that the chairs were not acceptable. As I stated earlier, you may pick up the chairs in Santa Ana. In regards to your proxy:   On Nov 30 16, also on 11.1.16 I asked Lisa for the address in Santa Ana, never got it.   On 12.6.16 I asked again for the location for me to pick up the complete dining set.   I never got a response.   Until today 4.5.17 so please do not have them contact me again.   Your refusal to allow me to change the height of the table was unreasonable. Your refusal to pay the balance while keeping the merchandise is tantamount to conversion. Thank you for your reply Oscar.  I have told you many times to pick up the chairs.  You never asked me for the address.  Further, there are no people at the address so a time and date must be scheduled with us to go there and unlock the warehouse.  Please let me know when and what time and I will have someone meet you. However, you chose to ignore those  opportunities to mitigate any damages you may claim, for the record, I have made every effort to accommodate your numerous subjective and ongoing caprices to avoid any unnecessary litigation. I delivered the dining set that was ordered and made every effort to adjust the height of the table. Performance was complete from my end. I did not charge you for the difference, when you were given the option you chose the cheapest pine chair both times, You even tried to chisel the price down because you said they were more simple than the 1st set of chairs.  IT WAS YOU WHO SAID YOU COULD MEET THE DATE.  WE KNEW NOTHING ABOUT A DIFFERENT AND INFERIOR MANUFACTURER, THAT WAS YOUR DOING   You paid for the cheapest pine chairs per your request, and that is what you should have received both times.  I MADE NO SUCH REQUEST.   You didn’t have to keep an order you did not like, I offered to pay back your 50% deposit asked for the Dining Set 4 months ago.  Look at the receipt for your unauthorized repair.  If you did send me the address in Santa Ana to pick up, please send me a copy of that email.  SEE ABOVE   I also stated to You and your wife, that I would send someone to the site to adjust the dining set at no additional cost to you. However, you chose to ignore those  opportunities to mitigate any damages you may claim, for the record, I have made every effort to accommodate your numerous subjective and ongoing caprices to avoid any unnecessary litigation. I delivered the dining set that was ordered and made every effort to adjust the height of the table. Performance was complete from my end. Dear Bruce, you answered on April 4 the question of the 1st set of chairs, this proves no bait and switch but instead it was an upgrade at my expense in order to meet your tight delivery deadline.   You described the chair as “They were all great eat”   If you look at the this same mail string there are progress pictures of the chairs you purchased, the chairs your were supposed to get because you ordered the cheapest of the 2 options I gave you. Read your emails.   (I have those chairs in storage because they were not going to be ready in time to your delivery date) Let me know if you need pictures, I will be happy to send them to you.   I only need the copy of the table modification invoice so that I can try to get this issue settled, I am not interested in complaining to the California State Bar about your wife using proxy emails, that is at the very least unethical.   I will not email you after I get this copy of Invoice, please do not deny me access this evidence.
