Hello Waiss today you will have a visitor a garage door installer he is licensed and bonded in San Diego he is the best I could find.

My guy went to Mexico City to tend his ailing father its been 2 weeks I have waited for him yesterday he tells me he has to stay a little longer, so I decided to move forward with another installer.

They will be asking for Sergio. I will call this afternoon

Waiss talked to this installer and requested that the door be lifted 14′  ( not the standard 8′ )  from the floor with a side special lift.

Installer requested for the interior be modified for this purpose, removing 1 1/2″ fake stone from the edges of the Garage entrance frame or from inside to fill the space with 2 x 4 wood studs for the door rails be anchored to wall.

Apparently we’ve had some miscommunication- are we ready for what? We’ve been ready for the door delivery for weeks- I thought the rest of the doors were all supposed to be delivered way back on April 9th but were delayed because you were having trouble getting the finishes done because of the weather.

Sergio thought YOU were delivering the rest of the doors last week, but then you sent me that email on April 23rd asking for our tax ID number for the shipping company (Comercializadora Tobamo?) to get them over the border, so we thought you hired a shipping company to deliver them because you couldn’t. Are you delivering them after all?

Or are you saying we have to pay the remaining amount in cash (COD = Cash On Delivery) when the rest of the doors get dropped off?

Anyway, let me know so we can get it sorted out,

Waiss said he talked to you about this, and Monday afternoon delivery is OK as long as it is BEFORE 3pm, because there’s no one at the jobsite after 3pm to accept delivery. If they can’t do delivery before 3pm on Monday, it will have to be Tuesday morning.

Could you let me know which works best for the delivery company so I can let the jobsite supervisor (Sergio) know when to expect it?

Hello Cat, I talked to Waiss and agreed to get delivery scheduled for Monday so doors will be picked tomorrow morning from the factory.

He asked me to hold a balance of 2,000.00 until all doors are installed. I will send you a copy of the Invoice (see attachment) for your records this payment is due before delivery.

The Garage door is separate deal delivery the following week. Balance is due when operation is tested.

OK I got your message confirming Waiss conversation, If it can not be delivered Monday before 1 pm it will be there Tuesday AM.

Please remind him about Payment if doors are in the truck waiting approval of delivery, doors may get damaged when unloaded and loaded again.

Hello Oscar, we need about 30 door casings and 2 doors short and the garage door ASAP please. Our guys are trying to work with the pocket door now.

 after acknowledgement of COD for the added items and final balance, the driver was made to wait almost an hour then  ( Sergio the job site manager)  told the delivery driver that “the money was paid and that Oscar said OK to unload doors and moldings”  an untrue statement.   

Need to know what to do.

Hello Cat, Please tell Waiss, it is OK with me if he hired someone to touch up the interior doors or change the moldings again if he wishes to do so.

I delivered all doors with moldings finished and accepted without any report of damage. That was the contract that we both entered into back in December 2013.

As an accommodation, I did offer to do a final check on all doors after all was done and retouch any stain damage caused during installation and re-modification of doors installed by a 3rd party.

July 25th was the last time I saw Waiss when doors were delivered: 1) Garage door: 2) doors from original order: and 3) the added door.

He asked about retouching the doors, with his nephew present, I responded that I would return the following week to check and re-touch any door that needed it.

At that time I believed doors had been paid pursuant to the contract. However, later that day I arrived at my office in Los Angeles, it became apparent that he had not made good on his word.

The partial payment of $1,000.00 payment constitutes a breach of contract on his part. He also said the job was on Via Capri was for a 3rd party and accordingly I extended a 20% trade courtesy discount. I later learned that the doors were for his own personal new house.

Thus, the basis of the 20% discount in the agreement was Waiss’s material misrepresentation that the contract was for a third party.

I reserved the right to exercise my right to revoke the 20% trade courtesy discount.

Even if he installs the Garage door, he is still liable for the balance.

This unpaid balance is now overdue. I anticipate the courtesy of prompt payment, otherwise I will have no other alternative but to refer this matter to my attorney,which may involve litigation, a lis pendens encumbrance, or lien on the subject property.

Please communicate to Waiss that in order to complete this job and resolved this situation that in good faith, I ask him to pay First for the balance on the delivered doors $601.46 plus $410.00 (50% of $820.00) for his Garage upgrade to complete 50% deposit.= $1.011,46 Please send a check I will contact you as soon as I received my due payment.

Based on his MO he needs to pay $2,505.20 ( the remaining 50% balance) this needs to be in either a Certified Check or Money Order payable to HaciendaRustica.com either one of these forms of payment must be presented when installers with all the custom ordered parts and components arrive to the job site and before installation takes place. As his word will not suffice.

In addition he needs to make preparations on his interior garage walls to adapt this garage upgrade Waiss added to the order (not the electric plug location).

The installer explained to Sergio what needs to be done, this is necessary in order to do the installation, I called on 7.31.14 twice to try to contact Sergio to confirm if this was done with no avail.

When I see the payment made $1,011.46 I will accept that Waiss entered the contract again in amicable terms.

Please do not make threats, that is very unprofessional and if necessary, American Express can pull back everything we paid you. Please try to maintain a businesslike manner during communication.

The garage door you sent has a warping problem that the installer is having a difficult time working around, but we are still working on it to get it done. We informed you previously we will run a reconciliation on our account with you after the work is finished and signed off by the inspector, and after deducting for the installation if there is money due you, it WILL be paid.

Please forward a copy of the fire rating so we finish the installation, calculate the installation costs and reconcile the account.
